Assalamualaikum Abg Wan,
we are law students from Uitm, and seeking your legal thoughts and opinion regarding our mooting question. Your time and assistance will be much appreciated by us. One of our mooting partner was a iium student and a friend of Sukinah.
Here are the question:

IN THE MOOT COURT OF UNIVERSITI TEKNOLOGI MARA
BETWEEN

INNO BUILD SDN BHD………………………………………………………RESPONDENT
Joe and Simon are close friends. They formed a partnership and have done well in their business. Both are well known among their business associates and have been described as the “dynamic duo” and are inseparable. Unfortunately their partnership was short – lived when Joe died tragically in an accident.
Due to the negligence of the contractor of the Respondent, a concrete wall from the 4th floor of a building under construction fell onto Joe’s car as he was turning into the road leading to his office, killing him instantly.
After witnessing his partner getting killed, Simon suffered nervous shock and was unable to work again. Eight months after the gruesome accident, Simon committed suicide. His estate sued Inno Build Sdn Bhd for negligence.
At the trial, Inno Build Sdn Bhd admitted liability for the said incident. The trial judge however held that Simon was not a foreseeable victim and thus did not award any damages to Simon’s estate.
Simon’s estate now appeals on the following grounds:
1. That Simon (the Deceased) was a foreseeable victim of Inno Build’s negligence.
2. That the estate is entitled to claim for damages. It was irrelevant whether the deceased is particularly vulnerable to nervous shock or not as once reasonable foresseability of the damage is proven, the respondent owes liability toward the deceased.
We are representing the respondent,i.e. Inno Build.
FYI, this question is specialized on nervous shock in torts.
We wonder whether we can argue on causation, remoteness of damage, suicide as novus actus interveniens,and negligence.
Our mooting will be held on 15th Aug and to make it more worse, we are the first group to perform.
