A Letter 2 My Studs

My dearest L2, L3 and P3,

I know dis wud be already outdated, really late in fact, but isn’t it dat its never too late for a wish? First and foremost, allow me, again, to welcome you to Taylor’s Legal Studies. U had made, I believe, a gud decision, embarking your future career’s path and in choosing a course in uni. (macam provost punyer speech laaa plak) lol


I wud not refute shud one claim da difficulty of da course. Blatantly true, its quite tough 4 first timers. And honestly, I am not an exception. A British-educated-law-graduate even, would still find it hard cuz Legal Studies offers a different spectrum for one to digest. But believe you me, with God’s help and His Mercy together with our self-determination we are able to make dis thru.


Our constitutional rule of law is simple – ‘love and respect’ yet meaningful to da minds and hearts. In fact, everyone breathing on dis mortal earth needs to be respected and to be loved. And so does our class. Lets create an enjoyable learning, full of fun and laughs. Let dere be no prejudice, hatredness and double-standard amongst us. Above all, we are just human in the eyes of God. We made mistakes and flaws but sumhow we learn sumting from them in da end. We are all an adult, wished to be treated as one.


Learning dat we are now approaching da fourth week of learning and teaching, undeniably, da stress has start kicking off. In fact, it has mounting up high to sum of you, leading to a feeling of ungrateful for enduring the course. And dat feeling is – regret. But guys, life offers no regret. Even how bad we’ve screwed up or how wrong da decision we took, we vow not to surrender till the day we leave dis world. There always be a wisdom behind everything dat human must embrace. Behind all mistakes and wrongs, dere lies God’s grace for us to grab.


Lets create our 11-month-stay in taylor’s a truly remarkable moment. So dat when we end up our life with success and glory, we will bump to each other and greet, ‘hey we are from taylors.’ Even to da furthest destination the destiny has brought us apart, da presence will always be felt in the hearts. But guys, I cant do it alone, by myself.


I need you. U might not think dat, despite having an awful day in college –teaching, marking, and meeting, (bla bla bla and da list goes on) u always be da reason why im still surviving in taylors. Ur happiness and warmth smile be da inner strength dat drives my passion to keep on doing what I am supposed to do. Without ur support and guidance, I am nobody. =(


So please dun leave me alone. I need u guys to help me to assist you. Did not we promise to each other to help ourselves n da rest in da name of success? Cuz we are like one big happy family – sharing and putting concerns more than we do to ourselves. And sumone has reminded me that – success isn’t about studying its about bonding. How true. So lets make dis happen 2gether, shall we?

Its not only a burdensome to you, its killing me as well. Slowly and silently. But so long we got each other standing at our sides, bring any storm or wind, we stand together still, holding our hands, firming our hearts and FIGHT. We can do this together guys, trust me. Last but not least, albeit to sum up – as I always say to myself , “ da only reason why we still keep on living is becuz we are still fighting” and we will keep on fighting till the day we finally close our eyes … for an everlasting happiness in the hereafter.

Revisiting Resolutions

Every year millions of people make New Year's resolutions and then fail to follow through on them. Here's a simple tip that will help you break this cycle and make your New Year's resolutions a reality.
One of the main reasons people fail to follow through on their New Year's resolutions is that a year is simply too long a time frame to work with. For example, if you set a New Year's resolution to lose 20 pounds by the end of the year, it is very easy to think,
"I've got all year to make this happen"
As soon as you start thinking like this, your resolution loses its appeal and you have no compelling reason to get started. All too often your resolution ends up in the 'someday basket'.
The secret to making your New Year's resolution a reality is to transform it into a '6 month resolution' and a '3 month resolution'.
To do this, first take your end of year resolution and divide it in half.

For example: 'I will lose 20 pounds by the end of the year' becomes…
I will lose 10 pounds by the end of June.
Next divide this in half again to create your 3 month resolution…
I will lose 5 pounds by the end of March.
You now have a goal that is only 90 days away which is much more compelling than a goal that you don't have to think about for twelve whole months.

This simple process is also a great way to check whether your New Year's resolutions are realistic. When you work out your 3 month resolution, you should feel that this is something you can achieve if you work hard for the next 90 days.
If on the other hand you discover that your 3 month resolution is completely impossible from where you are today, it is likely that your end of year goal is somewhat unrealistic. In this case, you should revise your goals until they feel achieveable. Remember your goals should inspire and motivate you to take action - they shouldn't scare or intimidate you!

The New Year is a great time to create plans and make a fresh start. So today I'd like to encourage you to use this simple technique to set specific and achieveable New Year's resolutions for 2008.

(1) Divide your end of year resolution in two to create your 6 month resolution
(2) Divide your 6 month resolution in two to create your 3 month resolution
(3) Assess your 3 month resolution to see if it is something you can achieve within 90 days
(4) Revise your goals accordingly

N Da least I Can Do (part2)


Dear friend,

I am not writing to you, with the thinking not being a councillor neither a good motivator. I dun know either, what’s da best piece of thots to share wif u at dis crucial moment. My mind is full of an empty space even my hearts strongly inclines to write sumting. Ppl say, da words don’t matter but the thots dat count. Solely believe on dis, I am replying to u wif da best effort dat I can.

Words are just words. It cud invite many rooms interpretations n inferences. At such, I honestly have no idea how my sayings cud be meaningful 2 u.

Do u ever know dat, life has a lot to offer than the exams? Exams are just a micro-part in parcelled in our life. In fact life itself is a test. So why fear? I regards exams are just a mean to test how much u’ve absorbed and able to demonstrate things u’ve learnt. But is it dats all you n me (da muslims) perceive knowledge? N I dun have to tell u dat, ‘ilm without execution is just like a tree without fruits’

Hence izzit (exam) make a big deal 2 us?

As 2 regard to fear, it’s the thing measurable and controllable by us. Its within ourselves. We determine whether we shud feel it or ignore it. Should it is failed to be handled, it disrupted da clarity of mind and firmness of da heart. Human normally ok to have fear, but never and ever it gets over you. (of course u are well-versed wat da things we shud fear n wat are not)



My instincts strongly persuade me to think u are just fine. Those aren’t new things to u, its just a reiteration in different ways n styles. N u dun need to be warned dat in life, dere’s a bigger matter needs to be examined. Dis isn’t even da beginning. i know u've much prepared n really look forward to facing da exam. i've nothing else 2 add-up since u've put up ur own light of inspiration. n wat a better motivation cud be other than the words of God from the Holy Qoran plus a good inspiration is born naturally within oneself i.e. from the heart

In da end, I indeed dun know how much dis rumbles can help. But ppl taught me 2 give a hand even tho it won’t be needed. Just trying my luck ere n being 25 yo has taught me, dere’s no harm in trying n not even worth to fear of doing one. No matter whether u will succeed or u might screwed up, both are far better than being one who fear without even trying. (trying wif failures is better than doing nothing)

Da reason why we are still living is because we are still fighting. Loosing a hope to live is loosing the chance to live

Recipe For A Niu Yer

Welcome 2008





Omg .. my niu yer eve party was awesome n remarkably happening. A blast. Me wif some old mates (high skewl buddies) witnessed da end of 2007 at KLCC park. Admitted, it was drizzling badly, but still din make us down to keep on cheering. Soon after da fireworks presentation (while hugging each other, reminiscing da ups and downs we’ve been thru) we made our way to Starhill @ Bukit Bintang.

N dere we go


All nite long singing, dancing like maniac (da malays will classify it as a state of ‘naik sheikh') LOL … best gils pleaseeeeeeee
My glasses were even damaged (not da lense but da frame was slightly unstable) when we were jumping while dancing (masa lagu 'destinasi cinta' ke ape ntah) huhu. But no worries, it has been fixed-up when I later stopped @ da optometry. U know, dat ‘seronok tak hengat’ kinda mood.

After 3 hours of clubbing, we headed to a ‘mamak’ stall nearby. Me had two bottles of sparkling water due to maximum dehydration muahahahahaha. Then we chatted 4 nearly two hours – laughing n having so much fun. (matilaaaaaa semua Zaman Jahiliyyah I terbongkar plis)

When we realised da restraunt was about to close, we made our way 2 Hang Tuah (approx 2 miles away) 2 get our wheels and drove back home. Reached me fren’s home, performing fajr prayer (berhibur pun kenelah ingat tuhan kannn) (^_^) n dats it – off to nowhere land wif no worries and concerns.

Upon returning to office, got dis email from ex-colleague. Kinda soul-purifying n inspiring I think. Thot of sharing wif u

Pakistan’n Bhutto Assasinated

Pakistani opposition leader Benazir Bhutto has been shot dead after a political rally.
Ms Bhutto, 54, died in hospital after being shot in the neck and chest.


"She has been martyred," said party official Rehman Malik.

The assassin struck moments after Ms Bhutto addressed crowds of supporters in the city of Rawalpindi.

She left the podium flanked by men in suits and stepped into an armoured car but as the vehicle made its way through the crowds, Ms Bhutto appeared through the roof to wave to supporters.
Moments later the attacker opened fire,
shooting her in the neck and chest before blowing himself up.

Police officer Mohammad Shahid said: "The man first fired at Bhutto's vehicle. She ducked and then he blew himself up."

At least 16 other people were killed in the blast.

Pakistani President Pervez Musharraf said her assassination was the work of terrorists and he called on the people for their support as he declared three days of mourning.

"This cruelty is the work of those terrorists with whom we are fighting," Musharraf said in a brief televised address.

"The biggest threat to Pakistan and this nation is from these terrorists. I seek unity and support from the nation. We will not sit and rest until we get rid of these terrorists, root them out."

Opposition groups warned that the killing could spark civil war in the nuclear armed nation.

I think da surmon is brilliant. Hitting da nose of da high class leaders 2 da very down level of commoners (like us!!!)

So have a look, n take a deep breath, reflecting on our surrounding

Today peace has become, throughout the world, a preoccupation not only for those responsible for the destiny of nations but even more so for broad sections of the population and innumerable individuals who generously and tenaciously dedicate themselves to creating an outlook of peace and to establish genuine peace between peoples and nations. This is comforting. But there is no hiding the fact that in spite of the efforts of all men and women of good will, there are still serious threats to peace in the world. Some of the threats take the form of divisions within various nations; others stem from deep-rooted and acute tensions between opposing nations and blocs within the community.

In reality, the confrontations that we witness today are distinguished from those of past history by certain new characteristics. In the first place they are worldwide: even a local conflict is often an expression of tensions originating elsewhere in the world. In the same way, it often happens that a conflict has profound effects far from where it broke out. Another characteristic is totality: present day tensions mobilize all the forces of the nations involved; moreover, selfish monopolization and even hostility are to be found today as much in the way economic life is run and in the technological application of science as in the way that the mass media or military resources are utilized.

Elsewhere, fear of a precarious peace, military and political imperatives, and economic and commercial interest lead to the establishment of arms stockpiles or to the sale of weapons capable of appalling destruction. The arms race, then, prevails over the great tasks of peace, which ought to unite peoples in new solidarity; it fosters sporadic but murderous conflicts and builds up the gravest threats. It is true that at first sight the cause of peace seems to be handicapped to a crippling extent.

But we must reach peace. Peace, as I said earlier, is threatened when uncertainty, doubt, and suspicion reign, and violence makes good use of this. Do we really want peace? Then we must dig deep within ourselves, and going beyond the divisions we find within us and between us, we must find the areas in which we can strengthen our convictions that human beings’ basic driving forces and the recognition of their real nature carry them toward openness to others, mutual respect, community and peace.

The course of this laborious search for the objective and universal truth about humanity, and the result of the search, will develop men and women of peace and dialogue, people who draw both strength and humility from a truth that they realize they must serve and not make use of for partisan interests.

Da Least I Can Do

I have a special friend who I always care and adore, but just cudnt say it thru. Its hurt learning dat somebody dat u care n concern, having da hardest time in life, but all u can do is nothing but only to pray fom far. U cudnt even lend ur ears, afraid of it will create a burden to the existing barrier and dilemma.

Ppl say, whatever comes from da heart, falls back to da heart. Even u whisper da sincerest wish to someone, at the highest mountain of earth – surrounded wif clouds and midst, da wind will take it away till it lands to da ears of da person. Hence, allow me to whisper my thoughtful prayers n hope to h_ _ in my blog, even I know they will never be heard to da person I care.

Dats da least I can do for a special friend




Dear friend,

Heard u r facing a hard moment dis tyme, but I’m sure dis isn’t da 1st. We both know dat u’ve encountered far more disastrous than dis. But u’ve made it thru. Believe me dear warior, dis is just a continuous of melancholic stanzas in life. The hardest time will pass, for u 2 reap da sweet moments dat follow.

Truth be told, I dun know how much sadness, undescribable n speechless linger ur thot @ da moment. But knowing ur notes, I know sumting real bad has happened. Even how useless or rubbish they rate you, or u weigh da ultimate outcome, every days passed is a process of learning. Bet me, even while walking down da lane in da middle of da nite, surrounded by darkness n serenity – doing nothing, carrying nothing, da heart n mind still learn

No one deserves to be lonely, but even one encounters, dere’s sumting can be gained. Da math is easy (despite I know I shudnt easily created maths formulae)

Loneliness (L) = Less Contact (LC)
LC = Less Commitment (LC2)
LC2 = More Focus (study + prep) – (meeting + activities)
More Focus = Success

Hence, Loneliness (L) = Focus (F) x Success (S) 2
L = FS2

Admittedly, it wudnt be as powerful as Einstein’s E=MC2, but its enough to shake ur mind

Muahahahahahaha

As to trust my dear, remember – dat trust is not to be given, but to be honoured. Thus, trust doesn’t come easily n we ought to trust nobody but for ourselves. Simply becuz, no one cud understand u better than u do

I know I am not included in ur circle of frens, justifying dat I ve no rites 2 spell all of these vividly to you. Da only least I can do, is to put dis in my blog, 4 da whole world 2 know how much I treasure you (even u will never know)

Memoirs of Wan-Z

In less than an hour, I’ll be stepping out from dis department, bringing in with me a bunch of experience, chapters of warmth memories.

How cud I explain my state of mind and feelings @ dis very moment? A state of joy 4 a niu beginning n a melancholic feel for a recent ending.

How cud I 4get da memories I’ve been thru ever since da first day I moved in?

How cud I make a move, learning and leaving behind a treasure of friendship dat we built, we sustained, n we cherished all dis while?

Its hard. Really hard indeed.

Of all da reasons I cud merge, dere’s only one I cud search – “I got 2 do wats da best 4 me

Abg Halim sed ‘leaving GRM wud be a loss as Risk Management is a a high demand in market” All I cud say – “I got 2 do wats da best 4 me

I cud see how disappoint Zairi was upon realizing my leaving, still I will say – “I got 2 do wats da best 4 me” mentor

Kak Yaty feels sumting will be missing and once proclaimed ‘takde Wan Z sunyilaaaa GRM ni” I’m sorry Kak Ti, “I got 2 do wats da best 4 me

Syira n Vicki will miss a gud companion, a gud listener, still “I’m sorry gurls, I got 2 do wats da best 4me”

Blatantly true. Saying sorry aint easy. Its da hardest word.

For whatever reasons speculating upon my resignation, I got nothing else to raise up but to say “I got 2 do wats da best 4 me

N I will now take dis stage 2 give my profoundest expressions of gratitude to God for everything He has made 2 me allowing me 2 spend sum parts of my life wif da rest of u, cherishing da gud time of laughters n tears (tapi takdelaaa smp nanes kannn)

"My Most Fondful Memory Period of Time if I Can Turn Back The Time"


0023 in da morningand its been raining since early afternoon.My double-glazed windows are painted wif delicate pearls of water which ever constantly merge to from tiny, merry streams racing each other down 2 da panes.I welcome da rain. I thank Lord 4 dis little miracle of His.




It was on 7 days b4, where all began. @ dat time, none of us had imagined how splendid da gath will b. Including me!! I thot it wud b just another ongoing social event wif -IHAB- &-WANZUL-I reached Stoddart House from a long tiring weekends @ Malaysia Hall. Greeted by Ihab n Wanzul, n by a new chap whom I never seen b4 -MIRUL- traversing all da way from Ukraine 4 his Europe Trip. He welcomed wif a smile & I reciprocated. da demarcation of geography never be a reason 4 us 2 break da silence.


Da expatriates of us thronged da table. Sharing - listening - learning - updating. For I felt its just a small world 4 us da humans 2 live on. God has destined dat we dun meet in our home country but in da land miles away - The Great Elizabethan Soil.

We still remember da funniest thing ever - how deceived n gullible WanZul was 4 a fren he didn't recognise. It was a complete furore, telling ya, as da burst explodes 2 every inch of da flat. da innocent mortal just happened to know -R GEN- who joined da Stoddart clan on da next day.

N dats wat we did. Filling da space wif laughters n jokes. Full of fun n blissful. We transformed da cramped flat of Stoddart House into a Chateaubrind of our own. I testify, none of a second went by where we felt left behind. We belonged 2 each other erasing da sense of alienation n da 'i'm-hollier-than-thou' enigma. Wondrously, it seems, da bond of frenship has been tied n sealed 4 ages 4 da fact we just met.


Until dis very moment, I boggle learning da miracle of dis.
Today, as I'm writing dis, I cud vignette all of our memories even unambigous - even we r separating 4 different paths in life, fighting 4 a survival, striving 4 a brighter future.

Sound n Clear.
Not even a bit is faded n blurred. To thou, I shall promise, da memory wud never decay, till da day I last see dis brandished earth.

Are all women like dis?




There was a blind girl who hated herself just because she was blind. She hated everyone except her loving boyfriend. He was always there for her. She said that if she could only see the world, she would marry her boyfriend.


One day, someone donated a pair of eyes to her and then she could see everything, including her boyfriend. Her boyfriend asked her, "now that you can see the world, will you marry me?" The girl was shocked when she saw that her boyfriend was blind too, and refused to marry him.


Her boyfriend walked away in tears, and latter wrote a letter to her saying, "JUST TAKE CARE OF MY EYES PLEASE."


This is how humans change when their status changes. Only few remember what life was before, and who has always been there in the most painful situations.

To be honest, I've blogged on dis kinda thing months ago, but I dun mind 2 reiterate da same, stressing how priceless da remembrance means 2 me.

However, please gimme a moment 2 get my arse sticks 2 da chairs as I'm currently tied to work's commitment. Will probably be on air mid next week, if not early.

Wud Dere Be A Better Hope For Our Children ?

Among the Malaysian legal practitioners, The Royal Speech was kinda like inspiring and full of bravery. It speaks out da malformation of their legal system. Undeniably, the voice of change has been ongoingly raised for the government to realise how sick the legal system is due to direct and indirect interference by them. But I supposed its just circling n hanging in the air – waiting and weakening.


Our neighbour, however, has been far too advanced than us (I believe). Dats Y they stand higher and stronger than us, allowing them mapping themselves proudly on the globe. Its not dat Im not a patriotic neither a non-nationalist (alrite2, I’ll watch 1957: Hati Malaya soon ok? Fair Enough!!) but its just da truth dat you and I got to bear, for my eyes cudn’t lie, my mouth cudn’t deny and my ears will never die.


History tells, we started from the very same point. We grew from da very beginning, sharing similar chronological events prior independent. But till dis moment of time, we have gone too far in our separate ways. Its like two twins were born together (obviously from da same mother laaaaaaaaaa kan …if not takkan jadi twins), but end up one’s been extremely taller from the other.


The Malaysians in many cases, r hardly to accept changes. We prefer to live things in day way it is, as long as it doesn't deteroriate 'our life'. 'Our life' referring 2 da individual bearers. So long it is yet 2 cause dangers/harm 2 others (which r not related 2 'em directly or indirectly), we tend to adopt da 'wait n see' culture. HOW BAD.

One of the most remembered disasters by the Malaysians, was da catastrophic flood, washing large parts of a Southern State in Malaysia. Da whole vicinity was sanked due to heavy rain PLUS A POOR DRAINAGE SYSTEM, despite countlessly advice and warnings signed 2 da authority 2 improve. And Godswilling, by just 4 nites of continuous downpour, we realised dat sumting ought 2 b done n worst, it shud be done ages ago.

We never learn dat "time waits 4 no man"

In fact, my rumbles wud juz be rumbles. A meaningless sayings 2 da authority. At least 2 draw da attention of my fellow readers. I can't do much 4 a change I'm afraid =( but wif da all I have, I'll do wif da best dat I can =)


Those two speeches below-attached are da evidence on my rumbles today. I’ve enclosed two different excerpts touching on the ground of justice and judiciary. I wud like to acknowledge ‘LifeInside’ for sparking dis idea to me. U always be a great inspiration for Asignofthecreator to live on. Coincidently, its just happened not too long after the 14th Malaysian Law Conference took place.


My motives are noble n clear – I am not blaming much on da current jokers who shape the silly – lelucons into the holliness of law neither da current law maker cum enforcer for enduring this ‘unofficially-accepted’ cancer in our judiciary, but just to highlight how serious we have gone wrong to our future inheritors. We deserve a better country where JUSTICE is upheld under the name of LAW and let dere be no suppression, interference and influence from other parties. ( u know wat I mean dun ya) PEACE

Why Singapore Is What It Is

Minister Mentor Lee Kuan Yew was the keynote speaker at the opening of the International Bar Association’s annual conference last night. This is his address.


TO UNDERSTAND Singapore, you have to know how we were suddenly thrown out of the Federation of Malaysia in 1965 and became an independent state. Peninsular Malaya had been Singapore’s hinterland ever since the British founded Singapore in 1819.


We faced a bleak future. We had no natural resources. A small island-nation in the middle of newly independent and nationalistic countries of Indonesia and Malaysia, each determined to cut Singapore off as the middleman. To survive, we had to create a Singapore different from our neighbours - clean, more efficient, more secure, with quality infrastructure and good living conditions.

We sought to provide an environment that our neighbours did not provide - First World standards of reliability and predictability. Important for investors and economic growth is the rule of law, implemented through an independent judiciary, an honest and efficient police force and effective law enforcement agencies. Had we not differentiated Singapore in this way, it would have languished and perished as a shrinking trading centre instead of becoming the thriving business hub it is today.


I studied law in the Cambridge Law School and am a barrister of Middle Temple, an English Inn of Court. I practised law for a decade before I first took office in 1959 as prime minister of self-governing Singapore. Therefore I knew the rule of law would give Singapore an advantage in the centre of South-east Asia where the law was often what was decided by the leader, whether a president or prime minister, often an ex-military man.


Singapore inherited a sound legal system from the British. Clear laws, easy access to justice and an efficient legal system provide the basis for citizens to compete equally in the market and to grow the economy.


A stable and predictable legal environment facilitates the enforcement of contractual rights and protection of property rights. The common law heritage and its developed contract law are known to and have helped attract investors. Our laws relating to financial services are similar to those of leading financial centres in other common law jurisdictions such as London and New York. As these are the two leading financial centres in the world, their laws govern most financial transactions worldwide. They are used freely in Singapore.


Since 1959 we have adopted English as our working language. While we have kept key English legal principles; after the United Kingdom joined the European Union, it adopted EU laws and doctrines. We have not followed them. Instead we have amended our laws to fit our needs and circumstances.


The independence of our courts is protected by the Constitution that prevents removal of judges from office by the executive. We established our final Court of Appeal in place of the Privy Council as our courts would be more familiar with our own legislation and local conditions and culture.


We still look to English precedents and examples, but increasingly we look also to those of United States, Australia, New Zealand and other Commonwealth countries. Even civil law countries have given us useful concepts and ideas, especially those adopted and incorporated as part of UNCITRAL trade laws.

Needs-based legislation

WE have special legislation to meet our needs: A multi-racial and multi-religious society is prone to conflicts. Race, language and religion in Singapore have to be handled sensitively, especially during elections. We have enacted the Religious Harmony Act and set up the Presidential Council for Minority Rights. We created Group Representation Constituencies to ensure minority representation in Parliament.


For good industrial relations, we enacted the Employment Act and Industrial Relations Act to provide the framework for our tripartite system of industrial ties, a system for collective bargaining, and an Industrial Arbitration Court to resolve industrial disputes.


For law and order, we have strong deterrent sentences for offences such as drug trafficking, kidnapping, unlawful possession of firearms. The Immigration Act provides for caning sentences to deter illegal immigrants and overstayers. For national security, the Internal Security Act allows for preventive detention, an effective response to terrorists.


By the 1980s, the system of courts we inherited from the British could not cope with the increasing volume of work. It needed to be modernised and to make use of IT. This also needed a chief justice who is not only legally qualified, but also has managerial and administrative experience to reform the system.


It was Chief Justice Yong Pung How (1990-2006) who had practised law for over two decades before he became a merchant banker and finally chairman of Singapore’s largest bank. He restructured the system, instituted new procedures, used IT in the courts, increased the number of judges and courts and selected the most able and balanced of those at the Bar to become judges.


The World Bank, in a report this year entitled Judiciary-led Reforms In Singapore - Framework Strategies And Lessons, stated: ‘Over the past 15 years, Singapore’s judicial system has been transformed from one that many viewed as characterised by inefficiencies, delays, and inadequate administrative capacity to one widely seen as among the most efficient and effective in the world.’


Attorney-General Chan Sek Keong, who has since become Chief Justice, will maintain these standards. Good governance, a sound legal framework and judiciary have resulted in stability and economic growth.

Transparency and integrity

OUR emphasis is on meritocracy, the building blocks of sound governance and integrity in our judiciary and legal system. The integrity of our financial systems withstood the turbulence of the 1997 Asian financial crisis that caused several of our neighbours’ banking systems to collapse. Singapore’s firm regulatory framework has facilitated economic progress.


Corruption, endemic in parts of the world, was seeping into Singapore in the 1950s when elections had introduced elected ministers in the transition to internal self- government. In 1959 when we took office in the first fully elected government, we moved swiftly to rid ourselves of corruption before it could become endemic.


Transparency International, a civil society organisation against corruption based in Berlin, has repeatedly listed Singapore among the top five of 163 countries. And the only one from Asia in the first five. Our system does not tolerate corruption and we have avoided the problems of widespread corruption that have plagued Asia. Our Corrupt Practices Investigation Bureau (CPIB) annually tabulates the cases brought against officers and executives from the public and private sectors. In two cases, it led to the conviction and prison sentence of a junior minister. Another, a Cabinet minister, committed suicide after being investigated for corruption.


Three factors enabled Singapore to escape the poverty that plagued the region: First, clean and efficient government; second, the character and capabilities of the leadership in charge; third, an industrious people, eager and quick to learn to be productive and gainfully employed.

Defamation

POLITICAL leaders in Singapore take action against opponents who make statements against them that impute dishonesty and lack of integrity. Situated in a region where ‘money politics’ is part of the political culture and an accepted way of life, any allegation of corruption in Singapore must be taken seriously.


It leads to an investigation by the CPIB, and/or an action for defamation against the person making the allegation to clear any doubts on the integrity of the government. As a result, people in Singapore do not equate their political leaders with second-hand car salesmen.


Economic competitiveness

INTERNATIONAL surveys of economic competitiveness of countries always include the legal framework and the administration of justice as key criteria in ranking such countries.
The Political and Risk Consultancy, World Economic Forum and other polls show that both foreigners and Singaporeans believe we have good judicial and legal systems, and fair administration of justice.


The Institute For Management Development World Competitiveness Yearbook has consistently ranked Singapore in the top two positions since 1997 under the Legal Framework component. (This category examines if the legal and regulatory framework encourages the competitiveness of enterprises.)


The World Bank released its study Doing Business Report 2007 in September last year. Singapore fared better in 2006, compared to the previous year, and has replaced New Zealand at the top spot. Despite these endorsements, we cannot be complacent. We have to respond to new challenges that technology and globalisation have brought upon us.


With technology increasingly sophisticated in a world that is increasingly borderless, crime has become multi-faceted, and multi-jurisdictional. Our legislative mechanisms have responded to meet these challenges. Many legal issues today require an international cooperation for solutions.

Law firms are also taking advantage of new global business opportunities and technologies. US and British law firms are able to venture aggressively into new markets, following their clients’ multi-jurisdictional businesses. Businesses span many countries and lawyers must meet the needs of their multinational clientele.


We need to maintain Singapore’s position as a city par excellence, with an environment that is clean, safe and vibrant to work in and live in. We try to retain our best, and we attract the best to come, settle and raise their families here.
